Terms of Service

1. General Provisions

These Terms of Service ("Agreement") govern the relationship between Fairen Ltd. ("Fairen," "we," "us") and the user ("you," "user") when using the Fairen platform available at fairen.io ("Service").

By using the Service, you confirm that you have read, understood, and agree to be bound by this Agreement in full. If you do not agree with these terms — please do not use the Service.

2. Description of the Service

Fairen is an AI-powered video generation platform. The Service allows users to create video content based on text prompts using artificial intelligence.

Fairen reserves the right to modify, supplement, or discontinue the Service or any of its features at any time — with or without notice — without any liability to the user.

3. Registration and Account

3.1. To use the Service, you must create an account by providing a valid email address and setting a password.

3.2. You agree to provide accurate, complete, and up-to-date information during registration and to keep it current at all times.

3.3. You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. If you suspect unauthorized access, notify us immediately at [email protected].

4. Payment and Billing

4.1. Fairen operates on a pay-as-you-go model: you pay only for the generations you actually use, with no mandatory subscription.

4.2. Payments are accepted via bank card (through Stripe) and cryptocurrency (through NOWPayments). Fairen does not store your payment card details — they are processed directly by the payment providers. Cryptocurrency transactions are irreversible by the nature of blockchain.

4.3. All payments are non-refundable, except as expressly provided in this Agreement or required by applicable law.

4.4. Fairen reserves the right to change its pricing, with at least 7 days' notice to users before changes take effect.

4.5. In the event of a technical failure resulting in an unsuccessful generation due to a fault on the part of the Service, the spent credits or funds will be returned to your account balance.

6. Prohibited Content and Use

When using the Service, it is strictly prohibited to create, upload, or distribute content that:

• depicts, facilitates, or promotes child sexual abuse (CSAM) — any such content will be immediately reported to law enforcement;
• is pornographic or explicitly sexual in nature;
• promotes, glorifies, or incites violence, terrorism, or extremism;
• infringes copyrights, trademarks, or other intellectual property rights of third parties;
• contains deepfakes of real individuals without their explicit consent;
• discriminates on the basis of race, ethnicity, religion, gender, sexual orientation, or other characteristics;
• constitutes disinformation, deliberately falsified news, or misleading material;
• violates the privacy or personal data of third parties.

It is also prohibited to:

• use the Service for any unlawful purpose;
• attempt to hack, overload, or otherwise disrupt the operation of the Service;
• use automated tools (bots, scripts) to circumvent Service limitations;
• resell access to the Service without Fairen's prior written consent;
• present Output Content as real footage in contexts where doing so could cause harm or mislead others.

Violation of these rules will result in immediate account termination without a refund.

7. Content Liability

7.1. Fairen does not pre-moderate all generated content and is not responsible for content created by users.

7.2. The user bears full responsibility for ensuring that Input and Output Content complies with applicable law.

7.3. Fairen employs automated filtering systems to prevent the generation of prohibited content but does not guarantee their absolute effectiveness.

8. Limitation of Liability

8.1. The Service is provided "as is" without any express or implied warranties of quality, uninterrupted operation, or fitness for a particular purpose.

8.2. Fairen shall not be liable for any indirect, incidental, special, or punitive damages, including lost profits, data loss, or reputational harm arising from the use or inability to use the Service.

8.3. Fairen's total liability to the user shall in no event exceed the amount actually paid by the user for the Service during the 3 (three) months preceding the claim.

9. Termination of Access

9.1. You may delete your account at any time in the account settings. Account deletion does not automatically entitle you to a refund.

9.2. Fairen reserves the right to suspend or terminate a user's access to the Service in the event of a breach of this Agreement — without prior notice and without a refund.

9.3. Upon account deletion, your data will be removed in accordance with our Privacy Policy.

10. Amendments to the Agreement

Fairen may amend this Agreement unilaterally. We will notify you of changes via email and/or an in-app notification at least 7 days before the changes take effect. Continued use of the Service after that period constitutes your acceptance of the updated terms.

11. Governing Law and Disputes

11.1. This Agreement is governed by the laws of the country in which Fairen is incorporated. Until the official registration of a legal entity, universally recognized principles of international commercial law shall apply.

11.2. The parties shall endeavor to resolve all disputes through negotiation. If a dispute cannot be resolved amicably, it shall be submitted to the courts at Fairen's place of incorporation.
